Welcome to MemoryMaps! We’re glad that you could come and see what we’re all about. Before proceeding with
using the application or website, please carefully review our Terms of Service and Privacy Policy so that you
understand all the agreements and practices we hold ourselves to when it comes to MemoryMaps's relationship
with you.
MemoryMaps provides you with several services and products. Whenever you browse or use MemoryMaps, specific
agreements need to be set between MemoryMaps and you, our user.
MemoryMaps operates under the entity "MemoryMaps LLC"
BY ACCESSING OR USING IN ANY MANNER, INCLUDING BUT NOT LIMITED TO BROWSING, VISITING, POSTING,
COMMENTING, PURCHASING, SCRAPING, AND CRAWLING THE SITE "MEMORYMAPS.APP", OR ITS APP "MEMORYMAPS", YOU AND ALL USERS AGREE TO THE FOLLOWING TERMS OF SERVICE THAT REPRESENT THE AGREEMENT BETWEEN
YOU AND MEMORYMAPS LLC, ITS PARENT COMPANIES, AND SUBSIDIARIES.
Please be sure to carefully look them over before accessing or using our platform.
The following Terms of Use (the “Terms”) and the Privacy Policy (“Privacy Policy”)
represent agreements between the MemoryMaps website and application along with all of its services, parents,
subsidiaries, and affiliated websites which can be located at https://memorymaps.app/ (“the Site”), with you (the “User”, and with other
users of the Site collectively the “Users”, "users", or individually the "user"). MemoryMaps serves a variety of functions to Users, including
licensing for using our application, writing content, viewing content, interacting with content, paid
subscriptions to content, and other available services (the “Services”). The usage of the MemoryMaps Site and
any of its content, including but not limited to its listed products, text, images, audio, layout, look-feel,
buttons, logos, graphics, art, animations, videos, comments, reviews, descriptions, ratings, functions,
audios, and code (the “Content”), signifies that you, the User, agree to be bound by these Terms in full. Site
content is reliant on the frictionless operation of network operations that are facilitated through our data
servers and third-party partners. The Site, Services, and Content (collectively, the “Platform” or
“MemoryMaps”) are owned, controlled, and operated by MemoryMaps LLC and its parent companies (referred to as “We”,
” Us”, ”Our”, ”Ourselves”, ”The Team”, "MemoryMaps"), which are
entities located in Kansas, in the country of the United States of America.
By accessing the memorymaps.app website and corresponding application
"MemoryMaps", the User agrees to have confirmed to have read the Terms, agrees to be bound by
applicable statutes, laws and regulations, and agrees to be truthfully compliant and responsible with
applicable laws.
The usage of the MemoryMaps warrants that the user is at least 18 years of age
and have a fully and unobstructed ability to contract under legal statute and law. The user may also be under the age of 18 years of age if a legal parent or guardian is managing the account for them. If you are a child under
the age of 18, you are not permitted to use the Platform’s services without the involvement and consent of a legal parent or
guardian.
By accessing or using any part of MemoryMaps and its services, you confirm,
acknowledge, and declare that you are not a national or resident of any country that has been issued trade
sanctions, economic sanctions, or embargoed goods and services by the United States of America or the
United Nations Security Council. You must at all times comply with all current US export laws and
restrictions that have been placed on any product(s) or service(s) that you use on MemoryMaps.
Transactions that occur on MemoryMaps warrant that all funds are legally owned or controlled by you and
that you will not be engaging in any form of unlawful activity.
If these Terms are not agreed with, the user is hereby prohibited from any interaction with the
MemoryMaps, including the usage or access of our application, services, and subsidiaries.
We reserve the right to terminate any access to MemoryMaps and any services for any reason, at any time, at
our sole and absolute discretion.
Any use of MemoryMaps and its services is a complete and unquestioned acceptance of our Terms of Service
listed in this notice.
Subject to the agreement to the conditions and restrictions of the Terms and
Privacy Policy, MemoryMaps hereby grants you a fully paid, personal, limited, revocable, non-sublicensable,
non-exclusive, non-transferable, non-assignable, license to access and use the services, affiliated websites,
content, information, functionality, and available free services of MemoryMaps (collectively, the “Services”)
solely for informational, transactional, and other approved purposes expressed by MemoryMaps, which may change
in time. Using the Services for any other reason not approved by MemoryMaps is strictly prohibited. All other
rights not mentioned, expressed, or granted in these Terms are reserved for MemoryMaps and its approved
licensors. You agree that you may not fund, commence, commit, assist in, be involved in, or participate in the
acts of copying, replicating, reproducing, duplicating, transmitting, selling, reselling, stealing,
distributing, licensing, re-licensing, de-compiling, disassembling, modifying, publishing, hacking, scanning,
mining data, extracting information, phishing, spoofing, reverse engineering, creating derivative works of, or
any other acts that may exploit, abuse, or disparage any of the Content from any part of MemoryMaps, any part
of all of its Services, or any related derivatives works on the Platform for any purposes including commercial
and non-commercial purposes. You are not permitted to use framing or similar methods to display any part of
MemoryMap's website, logos, trademarks, images, its Services, or any part of its Content for any purpose
without prior expressed written consent. Furthermore, MemoryMaps reserves the right to mend or equally balance
any consequences using all powers available at law for any such violation. The misuse of MemoryMaps is
strictly forbidden. MemoryMap's services and products are available to use as permittable by all laws within
the jurisdiction of the United States of America.
MemoryMaps reserves the right to remove any content created by any entity or User on its platform for any reason at any time.
If you violate any part of these Terms, your license will be terminated
immediately without notice, and your permission to access and use of MemoryMaps may be terminated permanently
or for an indefinite duration.
By using MemoryMaps, you agree to our Privacy Policy, which can be viewed at
memorymaps.app/privacy. Our Privacy Policy explains how
we preserve, protect, and use your information when you provide it to us while using our services. We use
your information in the practices outlined in the Privacy Policy. Please be sure to carefully read the notice
before using MemoryMaps.
If you violate any part of these Terms, your license will be terminated
immediately without notice, and your permission to access and use of MemoryMaps may be terminated permanently
or for an indefinite duration.
All trademarks, logos, graphics, and trade names that include "MemoryMaps," "MemoryMaps.app" and / or similar derivative logos or graphics (collectively, the “Trademarks” of
MemoryMaps) displayed on the Site, Products, or Services are registered and unregistered Trademarks of
MemoryMaps, its owners, and partners. These trademarks are not available for use by any party unless
authorized by MemoryMaps, authorized delegates of MemoryMaps, or owners of the Trademarks. MemoryMap's
trademarks may not be used in any manner that might cause a confusion to customers or users. MemoryMap's
Trademarks may also not be used in association with anything that may discredit, confuse, belittle, or
denigrate MemoryMaps, including but not limited to products, services, items, reports, articles, newsletters,
and news outlets. Products or services offered by third-party sellers through MemoryMaps are the owners of
their respective trademarks and properties.
If you violate any part of these Terms, your license will be terminated
immediately without notice, and your permission to access and use of MemoryMaps may be terminated permanently
or for an indefinite duration.
All content including, but not limited to trademarks, copyrights, patents,
graphics, logos, designs, texts, images, documents, reports, internal code, software, functions, sound
effects, audios, music, art, animation, photographs, webpages, look-and-feel, user interface, navigation,
trade dress, stylistic characteristics, phrases, data, and site content contained within MemoryMaps and its
subsidiaries is the sole property of MemoryMaps.
All content created on MemoryMaps, including user-created-content
and content uploaded on MemoryMaps or any of its products and services are the property of the user
that created the content; however, by entering any information (including the user-created-content) to
MemoryMap's platform, the owner of the user created content grants a license for MemoryMaps to use for any purpose. This license granted to MemoryMaps by the user is fully paid-off,
non-exclusive, transferable, sub-licensable, royalty-free, and applicable worldwide for MemoryMaps to use for marketing purposes, research, data collection, service improvement, or any other action that MemoryMaps desires.
This license granted to MemoryMaps by the user is revoked and ends when the user deletes the content from their profile; however, MemoryMaps is granted a reasonable grace period of time not less than 120 days following the revocation to
remove the user's content from any of the use cases that MemoryMaps was using the content for. We believe this policy protects both MemoryMaps and the User while also providing the User with adequate control over their content
and propery rights.
The property of MemoryMaps is protected by the international
copyright laws of the United States of America.
If you violate any part of these Terms, your license will be terminated
immediately without notice, and your permission to access and use of MemoryMaps may be terminated permanently
or for an indefinite duration.
MemoryMaps cannot control any individuals or organizations that desire to attack
the network operations or data centers available for use on the Platform. As such, MemoryMaps cannot guarantee
the ability to prevent or mitigate attacks on networks, data centers, secure connections, or anything related
to the operation of MemoryMaps (the “Network”). The primary system of service on the Platform require the
frictionless operation of the Network. In the event that the Network is under attack, uncompromised, or in any
way that MemoryMaps deems temporarily or permanently unusable, Services that use the Network (such as data
fetching, uploading, storage, local data) could immediately be temporarily disabled. The longevity of the
temporarily disabled Services is a case-by-case basis, and MemoryMaps reserves the right to decide whether a
disabled Service on the Platform will continue to be discontinued, revived from discontinuation, permanently
discontinued, or will inherit any other status orientation that MemoryMaps at its sole discretion deems
suitable for each situation. This means that any user created content that has been derived from MemoryMap's
Services may be lost indefinitely and MemoryMaps does not hold any obligation to recover the Users property in
the event that it is lost due to any foreseeable and unforeseeable events including internal errors, network
attacks, third-party errors, and natural disasters, acts of God, credential hacks, theft of servers,
unauthorized accesses, accidental errors, unauthorized transfer of accounts, incorrect credential placement,
security issues, database errors, and disruptions of Network activity. MemoryMaps does not have any obligation
in engaging in activities that relate to defending the attacks of networks hosted by our third-party partners.
In the event of disabled Services on the Platform, as a courtesy, MemoryMaps will make reasonable efforts to
protect User property. In some cases, there are factors out of MemoryMap's control to protect a User’s data
from being stolen, such as an malicious failure of a Network. MemoryMaps will assume no representation, does
not warrant the safety of the Platform, and is not liable for any lost content, lost data, lost credentials,
or stolen property despite whether or not MemoryMaps was negligent in providing adequate security.
You agree to be sent communications through any information that you have provided for us about yourself.
MemoryMaps may periodically send you information that enhances the utility of our Platform in several
different ways. This may be done through scheduled phone calls, text messages, e-mail communications,
electronic notifications, site notifications, letters to the address that you have provided us. An example of
a communication transaction could include a response to a support request, or a confirmation of posting
content placed on our Platform.
On MemoryMaps, most services that we provide are not available to you until a user account is created. To
access our services, you must create an account with the following conditions.
You must meet all requirements outlined in the Terms, read and understand the Privacy Policy in full,
and agree to both the Terms and Privacy Policy.
You must provide information that is accurate, current, and valid when
creating an account on MemoryMaps.
You agree to update information that has been changed in your account. You must provide and keep your
current email address updated with us – not doing will likely result in incomplete service from
MemoryMaps. To edit your information, access the mobile application, go to the “Profile” tab, and find
“Edit Profile” or “Settings” in the navigation. There, you will see an option to edit your information.
Preserve the security of your account with strong credential information. Do not use an identical or
similar password that you use on a different service.
You take full responsibility for all actions that occur on your account from the user side, including
but not limited to acts of God, credential hacks, theft of funds, unauthorized purchases
and disruptions of personal network activity. You agree that you do not hold MemoryMaps liable for any value
lost due to any activity that has been facilitated from a user session and accept all the risks that come
along with interacting with our Services.
You must strictly monitor your account and observe any suspicious activity that you find on the
Platform and will notify MemoryMaps immediately if you believe there has been a breach of the Terms,
Privacy Policy, or security of the Platform.
MemoryMaps reserves the right to regulate and limit the number of accounts that any user may create.
You certify that accounts created on the Platform are not transferrable under any normal circumstance and the
rights to approve a transfer of an account is solely reserved for MemoryMaps. You may not commit any
commercial, non-commercial, or charitable action including buying, selling, donating, distributing, or
reassigning any part of an account without expressed written consent from MemoryMaps. In the rare event that a
transfer is approved, you agree that all conditions drafted in these Terms indefinitely continue to be applied
to you, your account, and the new operator of the account.
To purchase products or use services available on MemoryMaps, you will need to fund your account with funds
obtained separately from the Platform.
You guarantee and certify that any funds you use on the Platform are valid, usable forms of currency
that has been obtained lawfully. You verify that you possess the legal authorization to carry out all delegacy
actions including purchases, transfers, deposits, billable transactions and withdrawals anywhere at any time with the currency.
MemoryMaps offers several outlets for posting personal content and thoughts, such
as comments, reviews, ratings, text, opinions, videos, images, submission boxes, ideas, suggestions,
questions, answers, and other content. Content that is illegal, slanderous, disparaging, libelous, false,
hostile, objectionable, solicitous, invasive, terroristic, pornographic, classified, harmful to third-parties; contains any
kind of malicious software related to “hacker” activities, viruses, bugs, trojans, keyloggers, worms, bots,
malware; or contains activities that can be classified as spam including chained text, excessively repeated
messages, disguised solicitous messages, or other texts MemoryMaps may classify as spam, is prohibited from
being posted onto the platform. You are forbidden from impersonating any part or form of an alternative
identity, including false e-mail addresses, fictional names, faulty shipping and mailing addresses, or invalid
phone numbers.
You certify that all content posted by you is content that you own or have the rights to use and control; all
content you post follows the Terms that are outlined in this document; and that the content is current,
accurate, and adds your contribution to the Platform.
MemoryMaps does not assume any liability or responsibility for any content that you, or a third-party may have
created. You agree to indemnify MemoryMaps for all claims from content that you have created, accessed, and
viewed on the Platform, and you assume all responsibility and consequences of your content, including content
entwined in legal, domestic, regional, personal, causational, and governmental issues throughout the world.
MemoryMaps reserves the right to remove, edit, or censor any content that it may deem unsuitable for the Platform.
Thank you for considering a subscription or purchase with MemoryMaps to support our ongoing development.
Subscribers will continuously receive the ongoing perks that have been subscribed to and potentially receive additional perks in the future.
Your MemoryMaps subscription will be charged through your iTunes Account after the confirmation of your purchased.
Payments are made securely through Apple servers.
Your account will be charged the same price for renewal subscriptions at the end of your subscription period to begin your new subscription period.
Your subscription is automatically renewed unless cancelled in your App Store settings.
When you create a new transaction or purchase an item, subscription, service, or the like on the Platform, you
agree to the Terms and Policies of making the purchase as a buyer in accordance to the policies of MemoryMaps
and the seller of the product.
MemoryMaps and its Platform may include services that provide a marketplace for
third-party sellers to list their products that they would like to sell. Sellers may determine most aspects of
their listings, and MemoryMaps does not initially vet most listings before posting it onto the Platform and
marketplace. You agree that you understand that MemoryMaps is not responsible for seller’s listings and action
on the listing. MemoryMaps will take reasonable steps to appropriate listings that has come to its attention
as inappropriate for the platform, but cannot guarantee certain aspects of a listing, including but not
limited to the accuracy, authenticity, validity, reliability, quality, or quantity of a listing or its product
information.
In most cases, sellers of their respective listings on the Platform determine the prices of the products that
they are selling.
You agree and understand that the prices and final prices that you observe, view, transact, perceive, or pay
may vary greatly, and are subject to immediate change at any given time you are not engaged within a checkout
session due to a seller changing the prices.
When you have initiated a checkout session, you will know the final price that is to be paid.
MemoryMaps does not usually charge you for your order until your order has been received by the Seller for
processing.
Refunds are currently unavailable due to the nature of the consumability of our products.
MemoryMaps will make reasonable efforts to complete, satisfy, assist, or recover funds from any malicious
transaction that is created on the Platform, but holds absolutely no guarantee, regardless of efforts, on the
completion, satisfaction, success, or recovery of funds in such transactions. MemoryMaps will not, in any
case, be held liable for any amount exceeding the fees collected by MemoryMaps for each respective transaction
due to causes related to incompletion of transfers or any other failure that MemoryMaps has no control over.
MemoryMaps will judge, at its sole discretion, utilizing the full-extent and reaches of the law, the
punishments and consequences of third-party sellers that participate in malicious activities on the Platform,
whether intentional or not, such as those, but not limited to, of fraud, merchant fraud, incompletion of
transactions, failure of delivery, failure of follow-through, scams, identity theft, misuse of the Platform,
inappropriate content, sale of restricted products, illegal activities, theft, or other activities that
MemoryMaps may deem not suitable for the Platform.
This Platform may contain links to other websites (the “Linked Sites”), which are not operated by MemoryMaps.
MemoryMaps is not responsible for examining or evaluating the content or accuracy and we do not warrant and
will not have any liability or responsibility for any third-party materials or websites, or for any other
materials, products, or services of third-parties.
MemoryMaps is not liable for any harm or damages related to the purchase or use of goods, services, resources,
content, or any other transactions made in connection with any third-party websites. Please review carefully
the third-party's policies and practices and make sure you understand them before you engage in any
transaction. Complaints, claims, concerns, or questions regarding third-party products/services should be
directed to the third-party.
MEMORYMAPS SERVICES, THE PLATFORM, AND ALL OTHER RELATED SOFTWARE AND SERVICES IS
PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS TO YOU BY MEMORYMAPS AND DOES NOT OFFER WARRANTY OF ANY KIND,
EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF RELIABILITY, ACCURACY OF
INFORMATION, STABILITY OF PRICES, COMPLETENESS OF TECHNOLOGY, AND FITNESS OF A PARTICULAR PURPOSE, TITLE, AND
NONINFRINGEMENT. MEMORYMAPS CANNOT WITH ANY SERVICES, COMMUNICATIONS, OR THIRD-PARTY MEMBERS OF THE SITE
GUARANTEE ERROR-FREE, VIRUS-FREE, COMPLETENESS, QUALITY, ACCURACY, OR RELIABILITY OF THE PLATFORM OR ANY OF
THE INFORMATION CONTAINED WITHIN AT ANY TIME. MEMORYMAPS WILL MAKE REASONABLE EFFORTS TO ENSURE THE PROCESSING
OF ALL TRANSACTIONS, INCLUDING WITHOUT LIMITING ORDERS, DEPOSITS, WITHDRAWALS, REQUESTS, OR PAYMENTS IN A
TIMELY FASHION, BUT MAKES ABSOLUTELY NO WARRANTIES OR REPRESENTATIONS ON THE AMOUNT OF TIME REQUIRED TO
PROCESS THE TRANSACTIONS. SOME TRANSACTIONS ON OUR PLATFORM SUCH AS DEPOSITS AND WITHDRAWALS ARE COMPLETELY
DEPENDENT ON FACTORS THAT ARE EXTERNALLY CREATED FROM THE PLATFORM AND ARE OUTSIDE OF OUR CONTROL INCLUDING,
WITHOUT LIMITING UNPRECEDENTED NETWORK ATTACKS, DENIAL OF SERVICE ATTACKS, UNRESPONSIVE THIRD-PARTY SERVICES,
AMONG OTHER FACTORS, MEMORYMAPS DOES NOT OFFER ANY REPRESENTATIONS OR WARRANTIES OF THE SUCCESS OR TIME NEEDED
FOR ALL TRANSACTIONS ON THE PLATFORM. BY ACCESSING AND USING OUR PLATFORM, YOU ACKNOWLEDGE, AGREE, AND
UNDERSTAND THAT ANY INFORMATION OR CONTENT THAT IS GIVEN, STORED, OR TRANSFERRED USING THE PLATFORM MAY
ETERNALLY AND IRRETRIEVABLY BECOME LOST, CORRUPTED, STOLEN, OR TEMPORARILY BE UNAVAILABLE AT THE CAUSE OF ONE
OR MANY DIFFERENT FACTORS, INCLUDING BUT NOT LIMITED TO ATTACKS, SOFTWARE FAILURES, INTERNET FAILURES,
GOVERNMENT INTERVENTIONS, ACTS OF GOD, TEMPORARY EMERGENCY HALTING OF ACTIVITIES, UNSCHEDULED MAINTENANCE,
THIRD-PARTY DENIAL OF SERVICE, INFRASTRUCTURE FAILURE, DENIAL OF SERVICE ATTACKS, OR EXTERNAL ATTACKS BY
THIRD-PARTIES. YOU ARE STRONGLY ADVISED TO TAKE PRECAUTIONARY MEASURES IN BACKING UP AND SAFEGUARDING YOUR
INFORMATION INCLUDING YOUR LOGIN CREDENTIALS AT ALL TIMES.
MEMORYMAPS HEREBY DISCLAIMS ITSELF OF ALL WARRANTIES AND REPRESENTATIONS ENLISTED, EXPRESSED OR IMPLIED IN
THIS DOCUMENT, WITH RESPECT TO THE PLATFORM, ALL SERVICES, AND ALL INFORMATION CONTAINED WITHIN, TO THE
MAXIMUM EXTENT PERMISSIBLE BY THE LAW. MEMORYMAPS SHALL HAVE NO LIABILITY FOR ANY DAMAGES OF ANY KIND
(INCLUDING BUT NOT LIMITED TO TORT, CONSEQUENTIAL, DIRECT, INDIRECT, OR SPECIAL DAMAGES) IN CONNECTION WITH
ANY USE OF THE SERVICES, CONTENT, PLATFORM, OR OTHER SERVICES PROVIDED TO YOU BY US, EVEN IF MEMORYMAPS HAS
KNOWLEDGE OR HAS BEEN ADVISED AND IS MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL
MEMORYMAP'S LIABILITY FOR MONEY DAMAGES UNDER THESE TERMS EXCEED THE TOTAL TIME-RELATIVE UNITED STATES DOLLAR
AMOUNT MEMORYMAPS RECEIVES FROM YOU IN THE PRECEDING SIX-MONTH PERIOD.
You agree to indemnify and hold Us (MemoryMaps, including its parents, affiliates, subsidiaries, joint ventures,
respective officers, managers, directors, advisors, employees, representatives, delegates, and agents)
harmless from any claim or demand (including reasonable legal fees, costs, and any fines, or fees or penalties
from the imposition of any regulatory authority) arising out of your breach of these Terms, our Privacy
Policy, any of our other Policies, the use of any part of our Platform, the violation of any law, rule,
property, or regulation, the violation of any rights of a third-party, or the violation of any rights of any
other Users of the platform.
The intellectual property rights in all software and content (including
photographic images) made available to you on or through this website and corresponding mobile application
remains the property of MemoryMaps or its licensors and are protected by copyright laws and treaties around
the world. All such rights are reserved by MemoryMaps and its licensors. You may store, print and display the
content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or
otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which
appears on this website nor may you use any such content in connection with any business or commercial
enterprise.
To request permission to use any Content other than as expressly permitted in these Terms, please contact
hello@memorymaps.app.
In addition, the look and feel of the Service, including all page headers, custom graphics, button icons, and
scripts, is the service mark, trademark, and/or trade dress of MemoryMaps and may not be copied, imitated, or
used, in whole or in part, without the prior written permission of MemoryMaps. All other trademarks,
registered trademarks, product names, and company names or logos mentioned in the Service are the property of
their respective owners.
You and MemoryMaps agree that any dispute, claim, or controversy between you and MemoryMaps or its divisions
arising in connection with or relating in any way to these Agreements or to your relationship with MemoryMaps
as a user of the Service will be determined by mandatory binding individual (not class) arbitration.
All disputes between you and MemoryMaps relating in any way to the MemoryMaps site and platform (INCLUDING
WITHOUT LIMITATION ORDERS MADE FROM THE MEMORYMAPS SITE, MEMORYMAPS ADVERTISEMENTS AND DISCLOSURES, EMAIL AND
MOBILE SMS (TEXT) MESSAGES MEMORYMAPS SENDS TO YOU, OR RELATING TO THE COLLECTION OR USE OF ANY INFORMATION
ABOUT YOU IN CONNECTION WITH MEMORYMAPS), these terms, or your status as a user will be submitted to
confidential arbitration in the federal judicial district in which you reside, except to the extent that you
have, in any way, violated or threatened to violate any company intellectual property right.
You and MemoryMaps further agree that the arbitrator shall have the exclusive power to rule on his or her own
jurisdiction, including any objections with respect to the existence, scope or validity of the Arbitration
Agreement or to the arbitrability of any claim or counterclaim. Arbitration is more informal than a lawsuit in
court. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. There
may be more limited discovery than in court. The arbitrator must follow this agreement and can award the same
damages and relief as a court (including attorney fees), except that the arbitrator may not award any relief,
including declaratory or injunctive relief, benefiting anyone but the parties to the arbitration. This
arbitration provision will survive termination of the Agreements.
The MemoryMaps Platform and all of its services may contain statements that directly or indirectly create
perceptions, forecasts, plans, objectives, estimates, strategies, ideas, proposals, suggestions, goals,
ambitious targets, intents, or other forward-looking information or statements coming to the Platform.
Although MemoryMaps believes that all such statements are accurate and based on reasonable assumptions, there
is under no condition no assurance that can be given to the actual result, formation, establishment, or
creation of such statements. The actual results of the contents of the forward-looking statements may differ
in any way. MemoryMaps irrevocably reserves rights to change, amend, modify, edit, qualify, and control the
contents of the statements that have been created at its sole discretion.
Our Terms of Service, Privacy Policy, and any other policies (the “Policies”) available in relation to
MemoryMaps may be modified and amended at any time MemoryMaps believes such changes are necessary.
MemoryMaps reserves the right to make any changes to our Site, Content, Platform, and any aspect of our
business at any time.
Any changes and amendments to the Policies will be effective immediately to all sites and pages at MemoryMaps,
to all users, at the time precise moment the Policies are updated on the Site. We will notify and contact you
about changes to our Policies primarily through email and possibly through other modes of communication if you
have provided us with contact information. If you have not created an account with MemoryMaps, we have no
method of communicating to you. As a result, if you have not registered with MemoryMaps, you must review the
Privacy Policy and Terms of Service to see if there are any changes upon every access of the Platform.
By accessing or using our website, you agree that official notifications of amendments to the Terms and
Privacy Policy will be received through email or another form of electronic communication from MemoryMaps.
Continued use of MemoryMaps will represent your acceptance of all changes and modifications. If you do not
agree to this, you must stop using MemoryMaps and all of its services immediately.
Information regarding the latest updated version of our Terms of Service or other Policies will be available
at the beginning of the notice.

All conditions of the specific outlines of the Policies are hereby deemed severable. If any conditions
outlined in the Policies are for any reason deemed invalid or unenforceable from the contract, those specific
conditions shall be severed and will not affect the validity and enforceability of the remaining conditions.
In the case that MemoryMaps fails to exercise or enforce any conditions, rights, or provisions of these Terms,
the contract does not waiver, and your commitments, rights, conditions, and provisions of these Terms and
Policies are not waived. These Terms and Policies between us constitute a mutual agreement and understand that
govern our relationship, with your use of the Platform and Services. This agreement will supersede any prior
agreements, including but not limited to electronic communications, oral proposals, or written proposals.
Should there be any ambiguities in the interpretations of the Policies or Terms, they shall not be construed
against MemoryMaps.
